A state court has ordered that the former president pay R$1 million (roughly £138,000) in collective moral damages for remarks deemed discriminatory during his tenure in power.
The latest decision arrives just a week after the former leader was given a prison term of 27 years and three months in incarceration for leading an failed overthrow designed to overturn the outcome of the 2022 election.
While holding a live-streamed interaction in front of the presidential palace, the then-president reportedly described the natural hair of a Black supporter as a “habitat for insects.”
He also remarked that the man might have infestations, asking, “What do you breed in that curly afro?”
The defendant’s lawyers claimed that the words were not meant to be discriminatory, pointing out that the individual personally expressed he was not offended.
But, the judges determined that the comments constituted “humorous bigotry” and went beyond simple humor or lawful opinion.
“Racist commentary masked by jocular remarks, linking natural Black hairstyles to vermin linked to disgust and dirt, damages the honour and dignity of people of color and strengthens the prejudiced narrative,” declared one of the magistrates.
This legal action was filed by government lawyers and the public defender’s office, referencing several individual incidents made by the former president during livestreams in 2021.
Although a previous court had rejected the claim, the review panel collectively ruled against him, though they set a lower amount than the initial request.
Besides the former leader, the Brazilian government was also directed to pay R$1 million. Each may still appeal the ruling.
Currently, Bolsonaro remains under home confinement at his property in Brasília, barred from posting on digital networks.
Bolsonaro has not commented on the latest verdict.
Shortly after the ruling, the defendant was admitted to a clinic due to a serious case of diaphragmatic contractions, nausea, and low blood pressure, according to one of his offspring on a post.
This hospitalization followed a prior medical appointment for the removal of skin lesions.
Among Bolsonaro’s children, an elected official, commented on news of the ruling with the phrase: “Long live democracy!”
